The Inside Track

Facts about Hiring in the United States

The employment contracts in the United States are mainly on an “at-will” basis. This term means that the employee can quit the job at any time for any reason that they have. On the other hand it means that the employer can terminate the employment for any reason at any time. In terms of the country's Equal Opportunity Employment laws. An employer can’t fire a person on the basis of their sex, gender, race, religion, age, sexual orientation, mental or physical handicaps, or national origin.

Even though the “at-will” method is used by many workers, there are some cases where people have contracts that clearly outline the relationship between employee and employer.

There are a variety of contracts that are signed in the United States. For example written or oral contracts. In the written contracts the terms of the employment are clearly spelled out and they include the employee salary, benefits etc.

The standard working hours in the United States are 40 hours per week 8 hours per day, five days a week. But some jobs require less than 40 hours considered as part-time jobs and some jobs require more than 40 hours a week and they might pay for overtime.

In many cases Americans are not taking vacations and that is because they don’t have access to paid time off for vacation.

In the United States it is not required for an employer to provide the employee with paid sick leave. Under the terms of Family and Medical Leave Act (FMLA) if an employee does need to take time off due to illness, they are allowed up to 12 weeks of unpaid sick leave per year.
