Gig & on-demand payout terms

Last updated:

Gig Pay is a digital product developed by Native Teams for businesses that work with gig workers at scale, such as platforms, aggregators, fleet partners and companies that engage people for task-based or on-demand work. It gives those businesses the software they need to run their own gig operations in one place: onboarding, agreements, earnings data, payout workflows, cards and reporting, together with an app for their workers.

These Terms explain, in plain language, what Gig Pay is, what it is not, and who looks after what, so that you can use it with confidence. They apply together with our General terms of use and our Data Processing Agreement. Where you have signed an agreement with us that covers Gig Pay, that agreement takes priority over these Terms.

What Gig Pay is, and what it is not

At Native Teams, we build technology. With Gig Pay, we design, develop and maintain the digital tools that you use to manage your own workforce and your own payout operations, and our team is there to help you get the most out of them.

It is just as important to be clear about what Gig Pay is not. Native Teams does not become the employer of your workers, and we are not a party to the agreements you make with them. We are not a digital labour platform, a staffing provider or a labour intermediary, so we do not match workers with customers, allocate tasks, set pay or working conditions, or rate or manage anyone's work. We are also not a payment institution in our own right: the payment, account and card services available through Gig Pay are provided by licensed payment partners, under their own authorisation and terms. And while our tools are built to support compliance, we do not advise on your legal, tax or regulatory obligations.

Gig Pay is offered to businesses only. Individual gig workers do not sign up on their own. They receive access to the worker app when a business that uses Gig Pay invites them.

Platform work rules stay with your business

If your business works with gig workers, you will know that the rules for platform work are changing fast. In the European Union, the Platform Work Directive applies to digital labour platforms that organise work performed by individuals, for example by matching workers with customers, controlling how tasks, pay or working conditions are decided, or using automated systems to monitor and manage people. Among other things, it introduces a presumption of employment in certain situations, as well as rules on transparency and human oversight where work is managed by algorithms. Similar rules exist, or are on their way, in other countries too.

Because Gig Pay is software that you use to run your own operations, these rules apply to your business rather than to Native Teams. We do not connect workers with customers or organise their work. Whether your business is a digital labour platform, or is covered by any similar law, depends on how you operate, and that assessment is yours to make.

In practice, this means that your business remains responsible for deciding whether platform work, employment or intermediary rules apply to you in each country where you operate, and for engaging your workers on terms that reflect the real nature of the relationship, including any obligations that follow from a presumption of employment. You also remain responsible for how you manage your workforce, from allocating work and setting pay and conditions to any monitoring, rating or automated decisions you make, and for doing so in line with the transparency and human oversight rules that apply to you. The same goes for your reporting, record-keeping, tax, social security and licensing obligations, and for making sure that the data, instructions and settings you use in Gig Pay are accurate and lawful.

Our software, templates and resources are designed to make all of this easier, and we are always happy to show you how. They are not, however, legal advice for your specific situation.

What Gig Pay gives you

Workforce onboarding. Tools to invite workers individually, in bulk by file upload or through an integration, with identity verification built into the worker app.

Agreement management. Locally adapted templates for the agreements you conclude with your workers, which you review and adopt as your own.

Earnings and payout workflows. Tools to upload earnings data, have earnings calculated according to the rules you configure, review payout runs and release them, with support for multiple currencies and flexible schedules.

Cards and wallets. Access for your workers to accounts, wallets and virtual or physical cards provided by our licensed payment partners, where available in their country.

Reporting and visibility. Real-time dashboards, earnings summaries and payout histories, and notifications that keep workers informed of the status of their payments.

How payout workflows operate

Payout workflows in Gig Pay are configured and controlled by you. You decide whom to pay, how much and when, and you provide the earnings data on which each payout run is based. You are responsible for reviewing and approving each payout run, and for the accuracy of the data you submit.

The movement of funds is carried out by our licensed payment partners, using accounts and arrangements that are set up for your business in accordance with your agreement and the partners' own requirements. Before any account is opened or any payout is processed, our partners and we carry out identity verification, anti-money laundering, sanctions and fraud checks on your business and, through the app, on your workers. A payout may be held or declined where the law or our partners require it, or where information is missing or there is a reasonable suspicion of unlawful activity.

Taxes

Tax and social security obligations relating to your workforce remain with your business in the countries where it operates, and with each worker in relation to their own income. Native Teams does not withhold, report or pay taxes on behalf of your business or your workers under Gig Pay.

Your workers' experience

Your workers use the Native Teams app to complete their identity verification, follow their earnings and payment status, use their wallet and card where available, and get help. Their use of the app is governed by our General terms of use and by the terms of our payment partners, and any services they choose to use in their own name are governed by our Terms of Service for Individuals.

Personal information

When your workers' personal data is processed through Gig Pay, your business is the controller and Native Teams acts as its processor, in accordance with our Data Processing Agreement. Native Teams acts as a controller only for the limited information that the law requires us to process for our own purposes, such as identity verification and anti-money laundering checks.

Responsibility for your operations

Because Gig Pay is a tool that you use to run your own operations, you are responsible for how you use it. You agree to compensate Native Teams for claims, fines and costs that arise from your relationship with your workers, from any allegation of misclassification or from wage, benefit or regulatory claims relating to your business, from use of Gig Pay contrary to the law or these Terms, and from the data and instructions you provide. The detailed allocation of liability is set out in your agreement and our General terms of use.
