Global mobility & right-to-work terms
Last updated:
About these Terms
These Global Mobility & Right-to-Work Terms explain how our global mobility service works and what you can expect when you ask Native Teams to help your people work legally in another country. They describe the service, how we work with you and your people, what we need from each of you, and what you can rely on us to do.
These Terms are the agreement between you and Native Teams for the global mobility service. Together with the quote you accept for each case, which sets out the countries involved, the type of permit, the scope of our support and the applicable fees, they contain everything that governs the service. By accepting a quote or asking us to start work on a case, you agree to these Terms.
About the service
Moving people across borders involves complex and changing immigration rules, demanding documentation and close coordination with government authorities. Our global mobility service brings that work together in one place, so that you can hire and move talent with confidence and your people can relocate with as little stress as possible.
The service is available to businesses that are hiring or moving people internationally and, in some cases, to individuals who are arranging their own move. It can support a single move or an ongoing mobility programme across several countries, and it can be combined with our other services.
How these Terms fit with your other documents
These Terms apply together with our General terms of use, which govern your use of the Native Teams Platform and contain the general provisions that apply to all of our services, such as those on liability, confidentiality and disputes, and our Data Processing Agreement, which explains how we protect the personal data we handle on your behalf. If there is any inconsistency, the quote you accept prevails over these Terms in relation to the case it covers, and these Terms prevail over the General terms of use in relation to the global mobility service.
What the service covers
Depending on the scope agreed with you, the service can cover the following areas.
Anything that is not described in the quote you accept is not included. If your needs change, we are always happy to discuss how we can support you further.
How the process works
Every case is different, but most follow a similar path. We begin by understanding the person, the role, the country and the intended start date, and we carry out an eligibility assessment. We then share our recommendation with you, including the proposed route, the documents needed and an indicative timeline, and we agree the next steps with you.
Once you ask us to proceed, we collect the documents and information required, prepare the application, and check it carefully before it is submitted. While the application is being considered, we keep you and the person informed of its progress and respond to any questions from the authorities. When a decision is made, we explain what it means and what happens next, including any steps the person must take on arrival.
After the person has started work, we can continue to monitor their immigration status and permit expiry dates, so that renewals and changes are handled in good time and the person's right to work is never interrupted.
What we can and cannot promise
- We will assess each case carefully, recommend the route we believe is most suitable, and prepare applications to a high professional standard.
- We will keep you and your people informed throughout the process, and we will tell you promptly about anything that could affect the outcome or the timeline.
- Decisions on visas, permits and residence are made by government authorities, not by Native Teams. We cannot guarantee that an application will be approved or that it will be decided within a particular time.
- Processing times are set by the authorities and can change without notice. The timelines we share are our best estimate based on current experience, and we recommend that you plan start dates and travel with this in mind.
- Immigration laws and policies change frequently. We cannot be responsible for delays, refusals or other outcomes that result from changes in the law or in government policy after work on a case has begun, although we will always advise you on the options available.
Right-to-work checks
In almost every country, it is unlawful to employ a person who does not have the right to work there. Right-to-work checks are therefore an essential part of responsible employment, and they must be completed before a person begins work.
The employer remains legally responsible for making sure that each person has the right to work. We support employers by carrying out the required checks on their behalf, keeping appropriate records of those checks, and reminding them in good time when a person's permission is due to expire.
What we need from you
A successful application depends on accurate and complete information. We ask you to give us accurate details about the role, the salary, the working arrangements and the intended start date, and to tell us promptly about any change, such as a change in role, salary, location or working hours, because many permits depend on these details and changes may require the authorities to be notified.
When you ask us to support a person, you confirm that you have the authority and any consents required by law to share that person's information, and the information of any family members included in the case, with us for the purposes of the service.
Where a permit depends on your business acting as a sponsor or meeting other obligations, we ask you to cooperate with those requirements and to keep us informed of anything that could affect them. Please also make sure that the person does not travel to start work, or begin working, until we have confirmed that they have permission to do so.
What we need from your people
We also rely on the people we support. We ask them to provide complete, accurate and genuine information and documents, to respond to our requests in good time, to attend appointments with the authorities when required, and to comply with the conditions of their visa or permit. They should also tell us promptly about any change in their circumstances, such as a change of address, family situation or passport, and keep their documents valid and up to date.
If any information or document provided to us is inaccurate or misleading, an application may be refused or delayed, permission may be withdrawn, and future applications may be affected. We are unable to continue supporting a case where we have reason to believe that information provided is not genuine.
Fees
The fees for each case, together with any government fees and third-party costs that apply, are set out in the quote you accept. We will always tell you about the costs of a case in advance, including any additional expenses that may arise during the process.
The fees for the global mobility service are separate from, and are not included in, any expat fee that may apply under another Native Teams service for people working in expatriate or cross-border arrangements. Each is charged for a different service, and one does not replace the other.
Changes and cancellation
If you need to change or cancel a case, please let us know as soon as possible, so that we can stop work and avoid unnecessary steps. You can cancel a case at any time by notifying us.
The stage a case has reached affects what happens when it is cancelled. If a case is cancelled before the application has been submitted, we will refund any government or third-party fees that have not yet been paid out, together with thirty per cent of our service fee for that case. Once an application has been submitted, or if it is refused by the authorities, the work has been completed and the related costs, including government fees, have been incurred, so these amounts are not refundable.
We may stop providing the service for a case if the terms that apply to it are breached, or if significant changes in the law or regulatory requirements prevent us from continuing. If this happens, we will explain the reasons and discuss the options with you.
Protecting personal information
All information exchanged during the provision of the service is treated as confidential. Immigration work involves some of the most sensitive personal information a person can share, including passports, family details and, in some cases, medical or criminal record information required by the authorities. We handle this information with great care, use it only to provide the service, and protect it with appropriate security measures and restricted access.
Where we provide the service on behalf of a business, that business is the controller of the personal information involved and we act as its processor, in accordance with our Data Processing Agreement. Our Privacy Policy and Individual Privacy Notice explain this in more detail, including the limited situations in which we act as a controller.
When the service ends
If our work together ends, we will tell you the status of any open cases and agree with you how they should be completed or handed over. We will make the relevant records available to you, so that you can continue to meet your obligations, and we will remind you of any upcoming expiry dates or obligations that we are aware of.
