Global employment solutions terms
Last updated:
Great talent can be found everywhere, and you should be able to work with it wherever it is. Native Teams develops digital solutions that make it possible to build a team in countries around the world without setting up a local company. Through our Platform, supported by our specialists and local expertise, your team members are engaged on a compliant local basis, paid accurately and supported throughout, while you stay focused on building your business.
These Terms explain how our employment solutions work and how we work together, from the moment you decide to bring someone on board to the day they move on. They apply together with our General terms of use, our Data Processing Agreement and our Fees & Additional Services Policy. If you have signed a Master Services Agreement and Scope of Work with us, those documents set out the details of your engagement and take priority over these Terms.
Solutions shaped around you and each country
Every country has its own rules on how people can be engaged, and every business has its own way of working. That is why our solutions are not one-size-fits-all. Depending on the legal framework available in the relevant country, and on what fits your needs, your team member may be engaged through a locally compliant employment arrangement with a company in the Native Teams group or a trusted local partner, through a consulting arrangement where the local framework allows it, or through another structure tailored to your situation.
Before anyone starts, we explain the options available in that country, recommend the one that suits you best, and confirm the arrangement in your Scope of Work. Whatever the structure, the principle is the same: we provide the Platform and take care of the formal and administrative side of the engagement, and you lead the work and the team.
From first conversation to first payday
Welcoming a new team member
- Share your plans. Tell us about the person you would like to work with, the role, the country, the proposed compensation and the start date, and we will recommend the right engagement model and give you a clear estimate of the total cost.
- We take care of the checks. We review the proposed terms against the local framework, complete our compliance checks and confirm your new team member's right to work.
- The contract is ready. A localised contract that fits the chosen engagement model is prepared and sent to your new team member to sign.
- A smooth start. Your team member joins the Native Teams Platform, completes their onboarding and is registered with the local authorities where required.
- First payday. Payments run on schedule, and your team members are paid accurately and on time.
How long this takes depends on the country, the engagement model and how quickly we have the information we need, and we will always give you a realistic start date. If any proposed terms need adjusting to meet local requirements, we will let you know and suggest the best way forward.
What we take care of for you
Depending on the engagement model, we take care of the formal and administrative side of the engagement. This can include a compliant local contract, payroll or payment processing and the related documents, tax and social security contributions where they apply, statutory and additional benefits, leave and absence administration, records, and the registrations and filings the local authorities require. Your team members can also come to us with questions about their contract, pay or benefits, so that they always feel supported. Everything is visible and manageable through the Native Teams Platform.
Making changes together
Teams grow and roles evolve, and we are here to make every change easy. Whenever you would like to update someone's compensation, role, working hours, leave or place of work, just let us know through the Platform or your account manager before anything is agreed with your team member. Because these matters are governed by local law and by the contract in place, they need to be put into effect through the engaging entity. We will check what is required, prepare any contract updates, and make sure payments and registrations are updated correctly and on time.
The same applies to more sensitive situations, such as concerns about performance or conduct. Speak to us first, and we will help you handle them fairly and in line with the local framework, protecting both your business and your team members.
We want every working relationship to be one that everyone can be proud of. That is why we always act lawfully and fairly towards the people engaged through our solutions, and we ask the same of our clients, as set out in our Code of Conduct.
Working across borders
If a team member would like to work from another country, even for a short time, let us know in advance and we will help you get it right. Working across borders can affect tax, social security and immigration, so it may need some additional arrangements. Cross-border and expatriate arrangements can carry an additional fee, as described in our Fees & Additional Services Policy, and our Global Mobility & Right-to-Work service can support visas, work permits and relocation.
When someone moves on
Every engagement comes to an end eventually, whether because someone is moving on to something new, by mutual agreement, or for other reasons. When that time comes, we will make sure it is handled properly and respectfully, in line with the local framework and the contract in place.
Please speak to us before anything is communicated to your team member, and give us as much notice as possible of any planned ending. We will confirm the requirements, any notice period and the expected costs, and we will then take care of the process, from the paperwork and final payments to any deregistrations and certificates your team member needs. Costs that come with ending an engagement, such as payments during a notice period, unused holiday and any severance required by law or the contract, form part of the engagement costs.
Clear and transparent costs
You pay the costs of each engagement, which, depending on the engagement model, include compensation, any taxes and contributions, benefits and other costs required by local law, together with our service fee. You will see an estimate of the total cost before anyone starts, and every invoice clearly shows the engagement costs and our fee separately, so there are no surprises.
Because many of these costs are set by law and by the terms agreed with your team member, they can change over time, for example when tax rates or minimum wages change, and any change is reflected in your invoices from the date it applies. For some engagements, a deposit helps secure the obligations that come with the engagement, and the details are set out in your agreement.
Our fees are shown on our pricing page or in your agreement, and our Fees & Additional Services Policy explains how any additional services are charged.
Your work, protected
The contracts used in our solutions include confidentiality provisions and provisions on the ownership of the work your team member creates, to the extent local law allows. The rights in that work are transferred to you, as set out in your agreement, so you can be confident that the results of your team's work belong to your business.
Keeping everyone safe
To protect your business, your team and ours, we carry out know-your-business, anti-money laundering and sanctions checks before we begin and from time to time afterwards, as well as identity and right-to-work checks on the people engaged through our solutions. If these checks cannot be completed, or an engagement would not comply with the local framework, we may not be able to proceed, and we will always explain why where we can.
Looking after personal information
When we process personal information about your team members to provide our solutions, your business is the controller of that information and Native Teams acts as its processor, in accordance with our Data Processing Agreement. Where a Native Teams group company is the employing or contracting entity, it is responsible, as required by law, for the personal information it needs to fulfil its own legal obligations in that role. Our Privacy Policy and Individual Privacy Notice explain this in more detail.
