Employment contracts

What should an employment contract in Tunisia include?

Under the Labour Relations Law, every employment contract must be in writing and include:

  • Details of the contracting parties, including their residence or registered office.
  • The employment start date.
  • The job title and type of work, including a brief description of the duties to be performed.
  • Information on high-risk work, where applicable, including any special professional qualifications or skills required, requirements for special medical supervision, and the specific hazards associated with the work.
  • The place of work. If no specific location is stated, the employee is considered to work at the employer’s head office.
  • The duration of employment, for fixed-term contracts.
  • Whether the employment is full-time or part-time.
  • Regular daily or weekly working hours and the work schedule.
  • The base salary, expressed as monetary remuneration for the work performed in accordance with the law, collective agreement and employment contract.
  • Other benefits the employee is entitled to under the law and collective agreement.
  • Annual leave, or the method used to determine the employee’s annual leave entitlement.
  • The employer’s general acts that set out the employee’s working conditions.

What types of employment contracts exist in Tunisia?

Employment contracts can be either indefinite or fixed-term. Contracts without a specified duration are automatically considered indefinite.

Indefinite-term contracts are the primary form of employment agreement and provide ongoing employment without a predetermined end date.

Fixed-term contracts end based on an objective condition, such as a specific date, the completion of a particular task, or the occurrence of a predefined event.
